These Terms & Conditions apply to the use of Mahila massage and wellness services in Gozo, Malta.
By booking or attending a treatment, you confirm that you have read and understood these Terms & Conditions.
1. Eligibility
Mahila’s massage and wellness services are intended primarily for adults.
Clients under the age of 18 may only receive a treatment where this has been expressly agreed in advance and appropriate consent from a parent or legal guardian has been provided.
2. Health and contraindications
Before receiving a massage, clients are responsible for informing Mahila about any relevant health conditions, injuries, pregnancy, medication, allergies or other circumstances that may affect the safety or suitability of the treatment.
Clients should also inform the practitioner of any changes in their health or wellbeing before or during a treatment.
Massage treatments offered by Mahila are intended for relaxation and wellbeing and are not medical treatments. They are not intended to diagnose, treat or cure medical conditions.
If there is uncertainty about whether a massage is appropriate, the client should consult a qualified healthcare professional before booking or receiving treatment.
Mahila may refuse or discontinue a treatment where, in the practitioner’s reasonable judgement, continuing would present a safety concern.
Providing incomplete or inaccurate health information may affect the suitability of a treatment. Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
3. Appointments
Treatments are available by appointment only.
Mahila may contact the client before the appointment to confirm the booking.
If the appointment has not been confirmed within the requested confirmation period, Mahila may release the appointment time.
Clients are asked to arrive 5 minutes before the scheduled appointment time to allow time for preparation.
The scheduled appointment time is the start time of the treatment. If a client arrives late, the treatment may need to be shortened so that subsequent appointments can take place as scheduled.
The treatment time includes the appropriate preparation and completion of the treatment.
4. Cancellation and rescheduling
Mahila understands that plans can change. Clients are therefore asked to provide as much notice as possible when cancelling or changing an appointment.
Unless mandatory consumer rights apply:
- cancellations made at least 24 hours before the appointment may be made without a cancellation charge;
- cancellations made less than 24 hours before the appointment may be subject to a charge of up to 50% of the booked treatment price;
- cancellations made less than 12 hours before the appointment, or failure to attend, may be subject to a charge of up to 100% of the booked treatment price.
Rescheduling may be possible in exceptional circumstances. A booking may normally be rescheduled no more than twice and, where possible, at least 24 hours before the scheduled treatment.
These cancellation terms do not affect any mandatory rights that a consumer may have under applicable law.
5. Gift vouchers
Gift vouchers are subject to the terms stated on the voucher and at the time of purchase.
Unless otherwise stated:
- a gift voucher is valid for 3 months from the date of purchase;
- the validity period may be extended in exceptional circumstances at Mahila’s discretion;
- gift vouchers cannot normally be exchanged for cash;
- unused voucher value is not refundable after the applicable validity period;
- promotional offers, discounts, vouchers and coupons cannot normally be combined unless expressly stated otherwise.
6. Promotions and discounts
Unless expressly stated otherwise, promotions, discounts, gift vouchers and coupons cannot be combined.
The specific terms of an individual promotional offer may override this general rule where clearly stated.
7. Privacy and confidentiality
Mahila respects the privacy and dignity of its clients.
Clients are also expected to respect the privacy, dignity and personal boundaries of the practitioner.
Personal data is processed in accordance with Mahila’s Privacy Policy and applicable data protection law.
8. Appropriate behaviour
Mahila is a professional massage and wellness service.
Sexual comments, sexual propositions, inappropriate touching, harassment, aggression, intimidation or any other behaviour that is inappropriate for a professional treatment environment will not be tolerated.
Mahila reserves the right to refuse or immediately discontinue a treatment in such circumstances.
No refund will be provided for a treatment discontinued because of inappropriate or abusive behaviour by the client, subject to applicable consumer law.
9. Hygiene and infectious conditions
For the safety of clients and the practitioner, clients should not attend a treatment while experiencing a contagious illness or a condition that could reasonably create a health or hygiene risk.
Mahila reserves the right to postpone, refuse or discontinue a treatment where there are visible signs of an infectious condition or where continuing the treatment would create a reasonable safety concern.
10. Clothing and personal belongings
Clients will receive appropriate instructions regarding clothing and preparation for their treatment.
Where disposable underwear is provided, clients may choose to use it. Clients may also use their own underwear, understanding that massage oils or other products may potentially stain or damage clothing.
Clients are responsible for personal belongings brought to the treatment.
Mahila is not responsible for loss or damage to personal property except where such responsibility cannot lawfully be excluded.
11. Alcohol, smoking and substances
Clients must not attend a treatment while significantly affected by alcohol or recreational drugs.
Smoking and vaping are not permitted in the treatment area.
Mahila may refuse or discontinue a treatment where a client’s condition or behaviour creates a safety concern.
12. Equipment and property
Any equipment provided by Mahila must be used according to the practitioner’s instructions and for its intended purpose.
Clients may be held financially responsible for damage to Mahila’s property caused intentionally or through negligent or improper use, subject to applicable law.
13. Changes or cancellation by Mahila
Mahila reserves the right to cancel or reschedule an appointment because of illness, emergency, unforeseen circumstances or other reasonable causes.
Where Mahila cancels a prepaid appointment, the client will be offered an alternative appointment or an appropriate refund, subject to the circumstances and applicable law.
14. Consumer rights
Nothing in these Terms & Conditions is intended to exclude, restrict or replace any mandatory rights or protections granted to consumers under Maltese or European Union law.
Where a booking or purchase is made at a distance, additional consumer rights may apply.
15. Governing law
These Terms & Conditions are governed by the laws of Malta.
Nothing in these Terms & Conditions prevents a consumer from exercising any mandatory rights or remedies available under applicable consumer protection legislation.
